The Advice of Shaykh Abd Al-Muhsin Al-Abbaad Al-Badr To Those Who Rush To Make Rulings on others

 

Question:

Is there any advice for some of those students of knowledge who rush in making rulings upon others and obligate that which should not be obligated and inflate some issues which cause differing and in fact broaden differing?

And some of these are issues wherein there can be difference of opinion yet within these issues among the students of knowledge some of them exaggerate in censuring the opposer and it may even be the case that this is spread on some websites which then cause fitna among the students of knowledge.

Answer:

It is obligatory on every Muslim, and on the student of knowledge, to fear Allaah, Mighty and Majestic, and to be preoccupied with seeking knowledge and obtaining it and to know the way, or ways, that the Kibaar ’Ulama traversed such as: Shaykh Bin Baaz, Shaykh Ibn ’Uthaymeen, Shaykh ash-Shinqeetee and Shaykh al-Albaanee. Meaning: that a person has to safeguard and know what those Kibaar ’Ulama were upon in being preoccupied with knowledge.

As for the condition of a person being preoccupied with qeela wa qaal and following mistakes or searching out mistakes and warning from people on account of “he has such and such” then such a preoccupation makes people stay away from knowledge and to become preoccupied with that which is not befitting to become preoccupied with.

A person should only safeguard benefitting from knowledge and referring to it, and if an error is committed by a person, if the person is from Ahl us-Sunnah and from those who are preoccupied with knowledge, then such a person is neither to be abandoned nor warned against. Rather he is to be benefitted from and informed of his error and likewise his error is to be warned against. As for him being abandoned, censured and warned against then this is neither the way of justice nor of attaining knowledge.

Because if Ahl us-Sunnah was on this way then it would mean that they would bit by bit disappear and none of them would remain according to them! Rather, it is upon a person to safeguard attaining knowledge and be preoccupied with knowledge and not to become preoccupied with qeela wa qaal because those who become preoccupied with this do not attain knowledge and do not become preoccupied with knowledge, they only become preoccupied with qeela wa qaal.

No benefit at all is gained behind this and only harm is gained by them speaking about others. Being preoccupied with these issues which are not befitting to be preoccupied with, and which are not befitting for a person to preoccupy his time with, cuts off the route to benefitting from others who have good and are preoccupied with knowledge.

The Barelwi Claim: Ahmed Reza Khan Was Infallible

Abdul-Hakim Qadri wrote, ‘The pen and the tongue of Ahmad Raza was safe from all kinds of slips and errors in spite of it being known that an ‘Alim always falls into some kind of error. However he did commit even a single simple mistake.

Another correspondent suggested that, ‘Ahmad Raza never uttered any word that was according to the Sharia. Allah kept him safe from all kinds of slips and error’

Similarly: ‘Ahmad Raza was free from mistakes from childhood. The following of the straight path was made a trust in him.’ (Anwar Raza p.223)

The author wrote in ‘Anwar Raza’, Allah had purified his pen and tongue from all mistakes.

It was also said that Ahmad Raza was in the hands of Gauthe Azam
(Gauthe: (One who redresses another’s grievances, one who comes to someone’s help and aid).
Like a pen is in the hand of a writer, and Gauthe Azam was in the hand of the Messenger of Allaah (صلى الله عليه وسلم) like a pen is in the hands of a writer and the Messenger of Allah (صلى الله عليه وسلم) himself would not say anything other than revelation.

One Bareilavi poet praised Ahmad Raza thus:
‘Allah’s pleasure lies with the Prophet’s pleasure and the Prophet’s pleasure lies with the pleasure of Reza (Ahmed Reza Khan al-Barelvi).

Another follower argues that, ‘the existence of Ahmad Raza is a sign from amongst the signs of Allah.’

One of the mockers of the companions (may Allah be pleased with them) of the Messenger (صلى الله عليه وسلم) remarked about his Imam and guide: ‘Our paying visitors to the Bareilawi lessened our eagerness to visit the Companions of the Prophet.’

Exaggerating causes the grip of intellect to loosen. One of the Bareilawis writers enthused, ‘One day at the blessed age of just three and a half (he) was present near a Masjid and a person dresses as an Arab came by and spoke to him in Arabic. He replied in fluent Arabic and after that the man dressed as an Arab was never seen again.

Another said, ‘One day the teacher said, ‘O Ahmad! Are you a human or Jinn? It takes me time to teach you but it takes no time for you to learn’. At the age of 10, his father who also used to teach him said, ‘you don’t learn from me but you teach me’.

It is worth mentioning here that his teacher Mirza Gulam Qadir Baig was the brother of Ghulam Ahmad Qadiyani. (The founder of the Ahmadiyya / Qadiyani sect)

This pathetic attempt to refute the Salafees is found within Zayd Shaakir’s lecture ‘Introduction to following a Madhab’. It is devoid of any actual reference to the Imaams themselves and is well grounded in the tradition of Hamza Yoosuf industry of lectures, and this maybe explains why Zayd Shaakir has become a replica of Hamza Yoosuf!

The clone of Hamza Yoosuf states:

“Many of the people that claim to be salafees, if you ask them why do you mash your feet against the feet of the other guy in the prayer?
Whats your daleel?
How many (salafees) would be able to give you the hadeeth that justifies that practice and the proof of those who argue against it?
Because for your position to be based on knowledge you have to know both, what are your proofs and the proofs of those people that argue against that?….. but if you ask people for those proofs and what’s your daleel (the salafee) says “well, i read it in Naasiruddeen al-Albaanee’s “Pray as you have seen me pray” tayyib, then if you’re following that book and don’t know its proofs you are a muqallid. So the question is would you rather make taqleed of al-Albaanee or Shafi’ee, Maalik, Ahmad or Aboo Haneefah? That becomes a question, and personally I would rather rely on ash-Shafi’ee.”

The Ruling of Celebrating the Prophet (صلى الله عليه وسلم) Birthday

The sheikh has been asked as in “Fatawa sheikh Mohammad Al Salih Al Othaimeen”, prepared and organized by Ashraf Abdel Maksoud (1 / 126)

What is the ruling of celebrating the prophet’s birthday?

He answered:

We see that one’s faith can’t be perfected until he loves the messenger (صلى الله عليه وسلم) and glorifies him with what he should glorify him with, and with what is suitable for him (صلى الله عليه وسلم), and there is no doubt that the sending of the messenger (صلى الله عليه وسلم) and I don’t say his birth, but his sending as he wasn’t a messenger until he was sent, as people of knowledge have said, he has been informed by Iqra’ (Surah Al-‘Alaq) and has been sent by Al-Muddaththir (Surah Al-Muddaththir), and there is no doubt that his sending is a benefit to the whole mankind as Allah has said: Say (O Mohammad, صلى الله عليه وسلم) “O mankind!, verily I am sent to you all as the messenger of Allah, to whom belongs the dominion of the heavens and the earth. None has the right to be worshiped but he. It is he who gives life and causes death. So believe in Allah and his messenger, the prophet who can neither read nor write (i.e. Mohammad, صلى الله عليه وسلم), who believes in Allah and his words, and follow him so that you may be guided.” Al-‘Araf: 158.

And if he was so, then as a part of our glorification, respect, and politeness towards him, and as a part of taking him as a leader and someone to follow, is not to exceed than the worships he has legislated for us, because the messenger of Allah (صلى الله عليه وسلم) died and there was nothing good for his nation but he has showed it and has ordered us to do, and there was nothing evil for his Ummah, but he has clarified it and warned us from. So, as we believe in him as a leader and someone to follow, we don’t have the right to celebrate his birth or his sending, as celebration means happiness, joy, and showing glorification, and all these things are types of worship that get us closer to Allah, so we are not allowed to legislate in worships but what Allah and his messenger has legislated. So, celebrating the birthday is considered innovation, and the prophet (صلى الله عليه وسلم) said: “Every innovation is misguidance.” He has said this is general word, and he (صلى الله عليه وسلم) is the best to know what he says, the most eloquent in what he speaks, and the most advising in what he guides to, there is no doubt in this, and the messenger hasn’t excluded anything of the innovations that is not misguidance, and it is well known that misguidance is the opposite of guidance. That’s why The Al-Nasa’i reported another narration: “Every misguidance is in hellfire”, therefore if celebrating his birthday (صلى الله عليه وسلم) one of the things liked by Allah and his messenger, then it would have been permissible, and if it was permissible, then it would have been preserved, as Allah has ensured preserving his rulings, and if it was preserved, the guided caliphs, the companions, their followers and those who followed would have left it. Since they haven’t done anything of this, it has been know that this is not a part of the religion of Allah, and what I advice the Muslims in general with, is not to avoid such things whose legality haven’t been proved neither by the Qur’an nor by the traditions of the messenger of Allah (صلى الله عليه وسلم), nor in the deeds of the companions, and to pay attention to what is clear in the rulings as known obligatory and preferable deeds, and in it there is sufficiency and reform of the individual and the society.

And if you looked carefully into the conditions of those who are fond of such innovations, you will find them reluctant not only in doing preferable deeds, but also in doing duties and obligations. This is a part from the exaggeration in the prophet (صلى الله عليه وسلم) that is found in these celebrations, that leads to the major shirk (making partners with Allah) which causes one to get outside the religion, and that the messenger of Allah (صلى الله عليه وسلم) have fought people for it, and have made their bloods, money, and property lawful. We hear that there are some poems that are said during these celebrations that surely causes one to get out of the religion, as they repeat the saying of the Busiri:

O the most honored creature, who can I seek for refuge

But you, when a great accident happens to me

If you weren’t to take my hand on the day of resurrection

Shaking it, then say “Oh, foot slips!”

Among your generosity are this life and the other one

And among your knowledge is the knowledge of the tablet and the pen

Such attributes are due only to Allah, and I am astonished by who says such words. If he understands what he is saying, then how can he justify saying to the prophet: “Among you generosity is this life and the other one”, and “Among” here is stating that it is part of his generosity, and “the other one” is the hereafter. So, if this life and the one to come is among the generosity of the messenger (صلى الله عليه وسلم), and not all his generosity, then what is left for Allah, for sure, nothing would have been left, neither in this life nor in the hereafter. And also “And among your knowledge is the knowledge of he tablet and the pen”, and “Among” here is stating that it is part of his knowledge, and I don’t know what will be left for Allah, if we talked to the messenger (صلى الله عليه وسلم) with such speech.

And wait my Muslim brother… If you fear Allah, then give the messenger of Allah (صلى الله عليه وسلم) the degree Allah has given to him. He is the slave of Allah and his messenger, so say “Slave of Allah, and his messenger”. And believe in what Allah has commanded him to convey to all mankind: Say (O Mohammad, صلى الله عليه وسلم) “I don’t tell you that with me are the treasures of Allah, nor (that) I know the unseen; nor that I tell you I am an angel. I but follow what is revealed to me.” Al-An’am: 50, and what Allah has commanded him with when he said: Say (O Mohammad, صلى الله عليه وسلم) “It is not in my power to cause you harm, or to bring you to the right path.” Al-Jinn: 21, and in addition to that: Say (O Mohammad, صلى الله عليه وسلم) “None can protect me from Allah’s punishment (if I were to disobey him), nor can I find refuge except in him.” Al-Jinn: 22, even if Allah wants to do something to the messenger (صلى الله عليه وسلم), no one can protect him from Allah.

So, the net result of these festivals or celebrations of the prophet’s (صلى الله عليه وسلم) birthday, is not just limited to being an innovation in the religion, but also other bad things are added to it and can lead to major shirk.

Moreover, from what we have heard, there is intermixing between men and women, and there is clapping and using Duff (one-sided drum), etc.. and other bad things that no believer can have doubt in condemning them, and we are satisfied with what Allah and his messenger have legislated for us, as in it is the reform of the hearts, countries, and people.

[Q]: There is a group amongst us (here in the UK) called Hizb-ut-Tahreer. They call for the Islamic Khilaafah and they speak against the scholars. How can they be refuted and what is the way towards achieving the proper Islamic Khilaafah?

[A]: All praise be to Allaah and may the peace and blessings be on our prophet Muhammad, his family and Companions. I testify that there is no deity worthy of worship except Allaah – alone and with no partner. And I testify that Muhammad is His slave and Messenger. To proceed:

With regard to the issue of partisanship, people are divided into two parties: The party of Ar-Rahmaan (Allaah) and the party of ash-Shaytaan (the Devil). So the party of ar-Rahmaan – it is not permissible for them to be divided amongst themselves. Allaah, the Most High, says:

“Verily those who divide their Religion and break up into sects, you have no concern with them in the least.” [Surah Al-An’aam: 159]

And the Prophet (صلى الله عليه وسلم) said:

“The Jews split up into seventy-one or seventy-two sects. And the Christians split up into seventy-one or seventy-two sects. And my ummah will split up into seventy-three sects.”

This hadeeth was reported by Abu Dawood from the narration of Abu Hurairah (Radiya ‘Llahu ‘anhu). Abu Dawood reported a similar hadeeth from Mu’awiyah but in it there occurs:

“All of them (these sects) will be in the Hellfire, except one sect.” They asked: “Who is it O Messenger of Allaah?” He (صلى الله عليه وسلم) said: “The Jamaa’ah.” Then he said: “And there will indeed come a people of whom vain desires will move them just as rabies moves around the one it affects.”

And what the Prophet (صلى الله عليه وسلم) warned us of has already come to pass, for the desires have become many and the parties and groups have multiplied. And Allaah, the Lord of Glory, says in His Noble Book:

“And hold on tightly to the Rope of Allaah, all of you, and be not divided.” [Surah Aali ‘Imraan: 103]

The Prophet (صلى الله عليه وسلم) said:

“You will indeed follow the ways of those who came before you, step by step, even if they were to enter the hole of a lizard you would enter into it (after them).” We said: “O Messenger of Allaah, do you mean the Jews and the Christians?” He (Sallallahu ‘alaihi wa sallam) said: “Who else?”

And the Prophet (صلى الله عليه وسلم) said:

“The believer with respect to another believer is like a building, each part supports the other.”

As for these parties, then they chase each other away and they attack one another. In fact, if one were to say:

“These splitting into parties has actualized what the enemies of Islaam have desired from splitting up the ummah, dividing its ranks and weakening its strength” he would be speaking truthfully.

Therefore, (I say that) Hizb-ut-Tahreer is a hizb (party) that is wicked. Perhaps you think this is a grave statement since I am the first one to say such a thing, but it is proper that I introduce such a statement. So I say again, it is indeed a wicked party, which began in Jordan. They split away from the Ikhwaan al- Muslimoon, who wrote to them requesting them to return but they refused to go back to them. Their leader was Taqee-ud-Deen an-Nubahaanee.

Concerning the matters related to Creed, they say:
“Nothing should be accepted except for that which conforms to the intellect.”

So if there is found some hearing (of a report), then this hearing must be eliminated. That is why they reject the Punishment in the Grave and they reject that the Dajjaal will be brought forth.

And they have no concern for teaching good etiquettes nor with spreading knowledge. So it is a party that cultivates its followers upon seeking after and studying politics, which opposes the Religion. And it was once said to the leader of this group: “Why don’t we see any schools for the memorization of the Qur’aan in your party?” So he responded: “I do not want to produce dervishes!”

They rely on politics only, and they do not rely on knowledge and etiquettes, nor on the heart-softening narrations. And with regard to issues of Fiqh, they make it permissible for a man to shake hands with a woman that is not related to him. And they say that it is permissible for a woman to be a leader and that she can sit in a governing council (majlis ash-shuraa). In fact they even allow a disbeliever to be in the governing council and that he can be given general leadership positions! So it is a deviant group that has surpassed the extent of deviance.

And I am surprised at those who join and adhere to this party. So I advise every brother to stay far away from this group and to warn against it. And if it were not that we make excuses for them, that they misinterpret the texts, we would have said that they were disbelievers because they reject the Punishment in the Grave and they reject the coming of the Maseeh ad-Dajjaal. And their leader says that he does not like to teach his students the Qur’aan so that they will not come out as dervishes.
